Lindahl recognized for work on important CJEU copyright case
Lindahl has been presented with an Impact Case of the Year award for Sweden for its work in the Stim and SAMI v Fleetmanager Sweden and Nordisk Biluthyrning litigation, Case C 753/18. The award was announced at the Managing IP Awards 2021 virtual ceremony on March 30 2021.
The judgment of the Court of Justice of the EU in Stim and SAMI v Fleetmanager Sweden and Nordisk Biluthyrning was published on April 2 2020. The Court ruled that rental car companies with vehicles fitted with radio reception equipment do not constitute a ‘communication to the public’ under EU law and therefore they are not required to obtain a copyright licence from music collecting societies.
Lawyer Johan Åberg represented the Swedish Car Rental Association in the case, which clarified how the concept of communication to the public will be applied to emerging technologies.
