Last week, the Supreme Court handed down a judgment in an extensive case that has been going on since 2018. The dispute related to illegal value transfer and deficient cover liability in accordance with the Swedish Companies Act as well as recovery in bankruptcy. The Supreme Court chose to reverse the Court of Appeal’s judgment on repayment of SEK 20 million in favour of Lindahl’s client.
“For my client, Foxhouse Holding AB, this means that a distribution of profits of SEK 20 million, as well as interest of just over SEK 10 million, need not be paid back to the bankrupt’s estate, which would have been the case had the Court of Appeal’s judgment been upheld. It is of course a significant victory for my client and we are very pleased with the outcome,” says Anna Ramsay, partner and lawyer at Lindahl and counsel in the extensive case.
