On 20 June 2019, Sara Andersson and Mikael Wärnsby represented Baltic Cable AB at an oral hearing before the Court of Justice of the European Union (CJEU) in Luxembourg (case C 454-18). Baltic Cable AB owns and runs the HVDC power line “Baltic Cable” that links the Swedish and German electricity grids. The case concerns a request for a preliminary ruling from the Administrative Court in Linköping. The questions to the CJEU relate to, among other things, how so-called congestion income from the interconnection – which is Baltic Cable AB’s only source of revenue – can be used under EU Electricity Regulation 714/2009. The Advocate-General’s opinion on the case is expected on 3 October 2019. The CJEU’s ruling will follow subsequently, at which point the proceedings before the national court will be resumed.
